Audio of Durst in Bathroom Could Play 2 Ways in Murder Case

LOS ANGELES (AP) — The whispered words of Robert Durst recorded in an unguarded moment in a bathroom could come back to haunt him — or help him — as he faces a murder charge.
A possible move by prosecutors to introduce the incriminating material from a six-part documentary on his strange life and connection to three killings could backfire as interview footage did in the Michael Jackson molestation trial and the Robert Blake murder case.
In both cases, the defense was allowed under the “doctrine of completeness” to provide segments of interviews that presented their clients favorably without subjecting them to tough cross-examination.
“I submit that Blake didn’t have to testify and Michael Jackson didn’t have to testify because the prosecution foolishly wanted to introduce portions of their interviews,” said attorney Thomas Mesereau Jr., who represented both men. “They just got greedy. They were mesmerized by portions they thought could help them.”
In the Jackson case, the defense used unaired footage to counter damage done by “Living With Michael Jackson,” a damning documentary in which Jackson held hands with his accuser and spoke of letting children into his bed.
“I’d slit my wrists before I’d hurt a child,” Jackson said in one outtake shown by the defense, according to Mesereau, who won the performer’s acquittal 10 years ago.
In the Durst case, prosecutors could seek to play portions from “The Jinx: The Life and Deaths of Robert Durst,” that concluded with the eccentric millionaire off camera talking to himself in a bathroom with his wireless microphone still live.
“There it is. You’re caught!” Durst whispered before the sound of water running can be heard. “What the hell did I do? Killed them all, of course.”
Durst was arrested in New Orleans on Saturday, the day before the final episode aired.
He has been charged in Los Angeles with first-degree murder in the 2000 killing Susan Berman, the daughter a mobster and a close friend who acted as his spokeswoman after his wife disappeared in New York in 1982.
Durst, 71, who is estranged from a family that has a real estate empire worth an estimated $4 billion, has long denied killing Berman and Kathleen Durst, who was declared dead even though her body was never found. Investigators had reopened that case and planned to speak with Berman when she was shot once in the back of her head at her home near Beverly Hills.
After the killing, Durst disguised himself as a mute woman and moved into a cheap Galveston, Texas, boarding house where he killed an elderly neighbor in 2001. He claimed self-defense and was acquitted of murder but convicted of unlawfully disposing of the man’s body, which was found chopped up and floating in Galveston Bay.
While legal experts said Durst’s remarks off-camera and to filmmakers during the production will most likely be admissible, prosecutors will have to decide if they outweigh the possibility that the defense would play other portions of interviews showing him denying any killing.
“I would see this moment of unguarded truth as worth a lot of those denials,” said George Fisher, a former prosecutor and professor at Stanford Law School. “The flat out meaning of the statement is very clear on its face.”
In the case of Blake, prosecutors sought to introduce a portion of a jailhouse interview of the actor discussing his family with Barbara Walters because it contradicted other evidence. The defense then successfully pushed to bring in the rest of the interview.
“It did a great deal both to humanize him and so he wasn’t just seen as a celebrity,” said M. Gerald Schwartzbach, who won Blake’s acquittal on a murder charge involving the killing of his wife. “There was an image projected that a lot of people had about Robert as a difficult person. In this video, he came across as a very sympathetic person.”
Prosecutors are not commenting on the Berman case while Durst is still held in Louisiana, where he also faces firearms charges. A lawyer for Durst did not immediately return a call seeking comment.

FILM REVIEW: The Six Triple Eight: Tyler Perry Salutes WWII Black Women Soldiers

The Six Triple Eight tells the important yet often overlooked story of the 6888th Central Postal Directory Battalion, an all-Black, all-woman unit in World War II. The film chronicles the battalion’s efforts to clear a massive backlog of undelivered mail meant for U.S. troops, a task that was both vital and challenging. In a show-stopping speech atop a mountain of mail, Major Charity Adams, played fiercely by Kerry Washington, explains the importance of mail during wartime and its relationship to soldier morale. Adams, who is continuously denied promotions despite her impeccable professional performance, leads 855 Black women through 17 million pieces of mail in an abandoned, cold and drafty school rife with “vermin” to raise the morale of soldiers and bring closure to families who haven’t heard from loved ones in nearly a year.
The film features an all-star cast, including Susan Sarandon as Eleanor Roosevelt, Sam Waterston as President Franklin Delano Roosevelt, Oprah Winfrey as Mary McLeod Bethune, and Ebony Obsidian (Sistas, If Beale Street Could Talk), who shows her acting chops by holding her own playing Lena, a bereaved private, opposite Washington.
Lena is a highly sensitive and intelligent young woman who is distraught over the death of her Jewish “boyfriend,” Abram David (Gregg Sulkin), who is killed in the war. Instead of attending college, Lena enlists in the army to “fight Hitler.” En route to basic training in Georgia, Lena is joined with a group of women in the segregated battalion, all of whom are running away from a traumatic past and running towards a brighter future. What emerges is a strong sisterhood that bonds the women, whether in their barracks or crossing the big pond, which is one of the highlights of the film.
The Six Triple Eight has all of the tropes of a film set during the 1940s, including de facto segregation here and abroad, the mistreatment of Black women in and out of the service by any and everybody, aggressive white men using the N-word with the hard “R,” and older Black women whose hearts are free, but minds are shackled to fear that living in segregation and being subjected to impromptu violence, ridicule, jail or scorn brings to bear.
While the film elevates the untold story of the dynamic, pioneering, and committed Black servicewomen of the Six Triple Eight, the narrative falls prey to Perry’s signature style — heavy-handed dialogue, uneven performances and a redundant script that keeps beating viewers over the head with what many already know as opposed to what we need to know. For example, a short montage of the women working with the mail is usurped by abusive treatment from white, male leaders. A film like this would benefit more from seeing and understanding the dynamism, intelligence and dedication it took for these women to develop and implement a strategy to get this volume of mail to the soldiers and their families.
In another scene, the 6888 soldiers yell out their prior professions, which would prove helpful to keeping their assignment when they come under attack again from the white military men. Visually seeing the Black women demonstrate their talents would be far more satisfying than hearing them ticked off like a grocery list, which undermines the significance of their work and preparation for war as Black women during this harrowing time in history. The lack of emphasis on their skills and capabilities diminishes the overall impact of their story, leaving viewers wanting more depth and insight into their achievements.
While the film highlights the struggles these women faced against institutional racism and sexism, it ultimately falls short in delivering a nuanced portrayal of their significant contributions to the war effort. This is a must-see film because of the subject matter and strong performances by Washington and Obsidian, but the story’s execution makes it difficult to get through.
Tyler Perry is beloved as a filmmaker because he sometimes makes films that people need to see at a particular moment in time (For Colored Girls), resuscitates or helps to keep the careers of super accomplished actors alive (Debi Morgan, Alfre Woodward, Cicely Tyson) and gives young, talented actors like Obsidian, Taylor Polidore Williams (Beauty in Black, Snowfall, All-American HBCU) and Crystal Renee Hayslett (Zatima) a chance to play a lead role when mainstream Hollywood is taking too long. One thing Perry hasn’t done is extend that generosity of spirit to the same extent to the writing and directing categories. Debbie Allen choreographed the march scene for Six Triple Eight. What might this film have been had she directed the film?
This much-anticipated film is a love letter to Black servicewomen and a movie that audiences need to see now that would benefit immensely from stronger writing and direction. Six Triple Eight is a commendable effort to elevate an untold story, but it ultimately leaves viewers craving a more nuanced exploration of the remarkable women at its center.
Six Triple Eight is now playing on Netflix.

Ashleigh Johnson: Pioneering the Way in Water Polo
Ashleigh Johnson attended Princeton University, where she played for the Tigers and dominated collegiate water polo. During her time at Princeton, she became the program’s all-time leader in saves and was recognized for her extraordinary ability to anticipate plays and block shots. She was a three-time All-American and was pivotal in leading her team to multiple victories. Balancing rigorous academics and athletics, she graduated with a degree in Psychology, showcasing her determination both in and out of the pool.

Ashleigh Johnson has become a household name in the world of water polo, not only for her incredible athleticism and skill but also for breaking barriers as the first Black woman to represent the United States in the sport at the Olympic level. Her journey begins as a determined young athlete to a record-breaking goalkeeper.
Born on September 12, 1994, in Miami, Florida, Ashleigh grew up in a family that valued sports and academics. She attended Ransom Everglades School, where she was introduced to water polo. Despite water polo being a niche sport in her community, she quickly stood out for her remarkable agility, intelligence, and reflexes. Her unique skill set made her a natural fit for the demanding role of a goalkeeper.
Ashleigh attended Princeton University, where she played for the Tigers and dominated collegiate water polo. During her time at Princeton, she became the program’s all-time leader in saves and was recognized for her extraordinary ability to anticipate plays and block shots. She was a three-time All-American and was pivotal in leading her team to multiple victories. Balancing rigorous academics and athletics, she graduated with a degree in Psychology, showcasing her determination both in and out of the pool.
In 2016, Ashleigh made history as the first Black woman to be selected for the U.S. Olympic Water Polo Team. Representing her country at the Rio Olympics, she played a crucial role in helping Team USA secure the gold medal. Her stellar performances earned her the distinction of being named the tournament’s top goalkeeper, further cementing her status as one of the best players in the sport’s history.
Ashleigh didn’t just stop at one Olympic appearance. She continued her dominance in water polo, playing a key role in Team USA’s gold medal win at the 2020 Tokyo Olympics. Her ability to remain composed under pressure and deliver outstanding saves in crucial moments made her an irreplaceable member of the team.
At the age of 29, Johnson appeared in her third Olympiad in Paris at the 2024 Summer Olympics. Their first match was against Greece and the US team won easily and Johnson only gave up 4 points. U.S. Olympic head coach Adam Krikorian shared, “She’s an incredible athlete. She’s got great hand-eye coordination, great reflexes and reactions. And then she’s fiercely competitive – fiercely. And you would never know it by her demeanor or by the huge smile on her face. But to us, on the inside, we know how driven she is to be one of the best ever to do it.”
Team USA Women’s Water Polo ended their Olympic season in fourth place after a 10 – 11 loss to the Netherlands. Johnson only allowed 37 percent of the shots from the Netherlands.
Beyond her achievements in the pool, Ashleigh has used her platform to advocate for diversity in water polo and sports in general. As a trailblazer, she recognizes the importance of representation and works to encourage young athletes, particularly those from underrepresented backgrounds, to pursue their dreams.
Ashleigh has spoken about the challenges she faced as a Black woman in a predominantly white sport and how she turned those obstacles into opportunities for growth.
